This website is operated by KJC Coatings, LLC. Throughout the site, the terms “we”, “us”, and “our” refer to KJC Coatings, LLC. KCJ Coatings offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions, and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. 

Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions. 

Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

 

*All items purchased from KJC Coatings, LLC., are for lawful use only. It is our company policy to sell ammunition, firearms and firearm parts to US citizens only. KJC Coatings, LLC., is not an exporter and cannot ship outside of the U.S.A., or to freight forwarding companies who then ship outside the U.S. 

 

General Conditions 

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmission over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service or access the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 


Privacy Policy 

KJC Coatings, LLC., will not disclose buyers’ information to third parties. Cookies are used on this shopping site to track the contents of your shopping cart once you have selected an item(s), to store delivery addresses if the address book is used, and to store your details upon selecting the “Remember Me” option. Your submission of personal information through the store is governed by our “Privacy Policy”. 


Online Store Terms 

KJC Coatings, LLC., sells firearms, parts and accessories, only in accordance with Federal, State and Local firearms law. It is your responsibility to check your local and state laws to ensure the items in your order do not violate or will not be used to violate any Federal, State and Local firearms laws. 

By agree to these Terms and Conditions, you represent that you are at least the age of majority in your state or providence of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 

You may not use our products of any illegal or unauthorized purpose nor may you, in the use of the Terms and Conditions, violate any laws in your jurisdiction (including but not limited to copyright laws). 

You must not transmit any worms or viruses or any code of destructive nature. A breach or violation of any of the Terms and Conditions will result in an immediate termination of your “Services”. 


Accuracy, Timeliness of Information and Completeness 

We are not responsible if information made available on this is not accurate, current or complete. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more timely, or complete sources of information. Any reliance on the material on this site is at your own risk. 

This site may or may not contain certain historical information, Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligations to update any information on our site. It is your responsibility to monitor changes to our site.

 

Modifications to Prices and Services 

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time. We will not be liable to you or to any third party for any modifications, price changes, suspension or discontinuance of the service. 


Products or Services (if applicable) 

Certain products or services may be available exclusively online through the website. These products and/or services may have a limited quantities and are subject to return or exchange only in accordance of our Return Policy. We do our best in every effort to display as accurately as possible the colors and images of our products that appear in the store. We cannot guarantee that your mobile device or computer monitor’s display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our Products and/or Services to any person, geographic region or jurisdiction. We may exercise the right on a case-by-case basis. We reserve the right to limit the quantities of any products and/or services that we offer and feel fit to. All descriptions of products or product pricing are subject to change at any time without any notice, at the sole discretion of KJC Coatings, LLC. Furthermore, we reserve the right to discontinue any product at any time. Any offer for any product and/or service made on this site is void where prohibited. We do not warrant that the quality of any product(s), service(s), information or other materials purchased or obtained by will meet your expectations, or that any errors in the service will be corrected. 


Accuracy of Account Information and Billing 

We reserve the right to refuse any order you placed with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card and/or orders that use the same billing and/or shipping address. In the event we make changes to and/or cancel an order, we may attempt to notify you by contacting the e-mail, billing statement and/or phone number provided at the time the order was made. We reserve the right to limit and/or prohibit orders that, in our sole judgement appear to be placed dealers, resellers and/or distributors. You agree to provide current, complete and accurate purchase/account information for all purchases made at our store. You agree to promptly update your account and other information including your e-mail address and/or credit card numbers and expiration date so that we can complete your transaction(s) and contact you as needed regarding any orders placed. 


Errors and Inaccuracies 

Occasionally there may be information on our site or in the Terms and Conditions that contains typographical error or inaccuracies that may be related to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors and/or inaccuracies and to change or update information or cancel orders if any information on the service or on any related website is inaccurate at any time without prior notice [including after you have submitted your order]. We undertake no obligation to update, amend or clarify information in the Terms and Conditions or on any related website including without limitations, pricing information except as required by law. No specified update or refresh date applied in the Terms and Conditions or on any related website has been modified or updated. 


Third Party Links and Optional Tools 

Certain content, products and/or services available via our Service may include materials from third-party. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. Third-party links on this site may direct you their websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do warrant and will not have any liability or responsibility for any third-party materials or websites, for any other materials; products or services of third-parties. We are not liable for any harm or damages related to the purchases or use of goods, services, resources, content or any other transactions made in connection with any website from a third-party. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any representations, warranties, or conditions of any kind and without any endorsement. Any use by you of optional tools offered through the site is entirely at your own risk and discretion, you should ensure that you are familiar with and approve the terms on which tools are provided by relevant third-party provider. We may also, in the future, offer new services or features through the website including the release of new resources and tools. Such new features and/or services shall also be subject to these Terms and Conditions. 

Please review carefully the third-party policies/practices and sure you understand them before you engage in any transaction(s). Complaints, concerns, questions or claims regarding third-party product(s) should be directed to them. 


Limitations of Liability Statement 

In no case shall KJC Coatings, LLC., employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any loss, injury. claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind including without limitation lost profits, lost revenue or savings, loss of data, replacement costs or any similar damages, whether based in contract, tort [including negligence], strict liability or otherwise, arising from your use of any of the service or any products procured using the service or any other claim related in any way to your use of the service or any product, including but not limited to any errors and/or omissions in any content or any loss and/or damage of any kind incurred as a result of the use of the service or any content [product] posted, transmitted or otherwise made available via the service even if advised of their possibility. Some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law. 


Warranty Statement 

KJC Coatings, LLC., extends no warranty and is responsible for any damages due to failure of used products. Used parts and firearms are sold as is. We suggest having a certified gunsmith inspect, install and/or test all used parts and firearms before use. Owner’s manuals are not provided with all firearms. 

 *Most new products are fully warranted by the manufacturer and product returns should be arranged with these manufacturers.  

Furthermore, we do not guarantee, represent or warrant that your use of our service will be uninterrupted, secure, timely and/or error-free. We don’t warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time to cancel the service at any time without notice to you. You expressly agree that your use of, or inability to use the service is at your sole risk. The service: all products and services delivered to you through the service are [unless as expressly stated by us] provide ‘as is and/or ‘as available’ for your use without any representation, warranties or conditions of any kind whether expressed or implied including all implied warranties or conditions of merchantability, quality, fitness for a particular purpose; durability; title and non-infringement.  


Purchasing Ammunition 

By purchasing from KJC Coatings, LLC either online, over the phone or in person, you agree that you: 

    • Are at 21 years of age. 
    • Have never been convicted of a felony or crime punishable by imprisonment for a term exceeding one year. 
    • Have never been adjudicated as mentally defective or been committed to a mental institution. 
    • Have never been dishonorably discharged from the Armed Forces 
    • Are a U.S. citizen and have never renounced his/her US citizenship.
    • Have never been convicted of a misdemeanor crime or domestic violence. 
    • Are not currently subject to a court order that restrains you from harassing, stalking, or threatening an intimate partner or child. 


Purchasing Firearms 

    • The individual paying for a firearm(s) and picking up from the receiving FFL dealer must be the same person. You cannot purchase a firearm using another person's credit card. The BATFE considers this a straw purchase. 


The following applies to ALL Firearm purchases: 

    • You must be a citizen of the United Stated to make a purchase 
    • All items purchased from KJC Coatings, LLC are for lawful use only 
    • No “Straw Purchases” of firearms. An individual paying for the firearm and completing the Firearms Transaction Record must be the same person (intended owner) 
    • We reserve the right to deny a purchase for any reason 


It is required for you to have a copy of your signed FFL (Federal Firearms License or Collector of Curio & Relic License) on file with use before ordering firearms from this website. It is also required to have a copy of any local or state licenses required for a firearm purchase to be on file. All orders placed without, or prior to a signed copy of the FFL on file may be canceled without notice. KJC Coatings, LLC reserves the right to limit the purchase of multiple firearms.  

 

Firearm Transfer 

We are happy to transfer a firearm for you from another dealer or individual. There will be a $15.00 charge for transfers with a CCW from Ohio, and a $20.00 charge for transfer without CCW. 

We ask that you contact KJC Coatings before you have any firearm shipped to us, so that we can make note what is being shipped, who it is for and where it is coming from. If the sender needs a copy of our FFL, we can e-mail them a copy. 


Sales Tax Charge 

  • Sales tax will be collected for orders shipped.  


Orders shipped within the United States or picked up at our location will be charged Mongomery County, Ohio sales tax rate.  

    • A vendor’s License does not grant tax exempt status, only a completed Uniform Sale & use Tax Exemption/Resale Certificate. 
    • Any applicable tax-exempt certificates must be completed BEFORE purchases are made. No refunds of sales taxes will be given upon completion of the purchase(s).   


Payment Methods 

Orders placed on our website will require a credit card. If you come to our location to place your order, you may pay by Cash, Credit Card, or Money Order. 

    • For Credit Card orders we can only hold the order for 7 days. After the 7 days, we must process or cancel the order unless we have been notified prior to the 7th day. You can at any time reorder at your earliest opportunity. 
    • There is a $5,000 limit on cash transactions per order. This also applies to money orders. 
    • We do charge a 3% additional fee for the use of credit cards. We accept - VISA, Mastercard and Discover. 


Back Orders 

We currently do not offer the option to back order a product. 


Cancellation Policy 

Once an order has been placed on our website, we make no guarantee that it can be cancelled. Once an order is already in processing it cannot be cancelled. Please call us at (937)241-2944 or e-mail us at kjccoating1206@hotmail.com to inquire on the order status. 


CANCELED ORDERS CANNOT BE REVERSED. ALL CANCELLATIONS ARE FINAL. 

    • If the order has already been shipped, you must follow all the procedures for returns. 


Return Policy 

Due to the expenses incurred by returns, we will make every effort to ensure your order is shipped accurately and the product meets the standards of our advertising. If a return must be made, please note the following policies: 


    • No returns will be accepted after 30 days of the invoice date 
    • No returns on ammunition 
    • No returns on NFA items 
    • To return or exchange an item, you must first notify us that you would like to return an item via e-mail or phone number. At which we will discuss how to return or exchange your item. 
    • Return shipping charges are the customer’s responsibility. If the incorrect product was shipped by our error, a prepaid shipping label may be issues to return the item(s). 
    • Upon our receipt of the returned product(s) we reserve the right to evaluate the merchandise to determine if a refund or exchange will be made. 


Please Note: Defective items may be returned within 30 days, but there are no guarantees on Return Shipping or shipping back to the customers. Shipping for defective items is determined by Manufacturer and not us at KJC Coatings, unless KJC Coatings was at fault for defective item and if FFL item KCJ Coatings was non manufactured is responsible for transfer fees (unless picked locally, then arrangements can be made). 


Refunds 

Refunds will be issued in the same way original payment was made (i.e., credit card purchases will be returned in the form of a credit to the original card account), Credit card refunds are subject to a 3% return fee. NOTE: if we deem a return was made without reasonable cause, or wherein our judgement the product meets the advertised condition, the refund will be subject to a 25% restocking fee.  Fees charged by a dealer transferring a firearm to the end consumer will not be refunded for any reason. These transactions are at the full risk and expense of the consumer. 


Exchanges 

    • In most situations a refund will be processed for returned items. 


When returning merchandise to be exchanged please include estimated shipping charges to ship the replacement merchandise. All accessories originally shipped with the item must be returned with the item (including magazines, etc.) to receive a full refund. Return shipping charges will not be refunded.  

Accessories can be returned through any carrier. Long guns should be returned using Ground service through any carrier. Handguns should be returned using Nex Day Air services. Handguns may be returned via USPS but must be sent through an FFL Dealer. COD packages will be refused. Charged incurred from shipping centers will not be reimbursed.

Arbitration and Class Action Waiver 

    • Please read this carefully as it affects your rights. Any dispute or claim relating in any way to your use of KJC Coatings’ services will be resolved by binding arbitration, rather than court. 

This agreement to arbitrate is intended to be broadly interpreted, and expressly includes claims brought under the Telephone Comsumer Protection Act. 47 U.S.C § 227 et seq., or any other statute, regulation, or legal or equitable theory. You and KJC Coatings hereby agree that the Federal Arbitration Act, 9 U.S.C. 1, er seq. (“FAA”) applies to this agreement to arbitrate and governs all questions of whether a dispute is subject to arbitration. Unless you and we agree otherwise in writing, arbitration shall be administered by the American Arbitration Association’s Consumer Arbitration Rules in effect at the time of filing of the arbitration (the “AAA’s Rules”). However just as a court would, the arbitrator or arbitrators must honor the terms and limitations in this Agreement and can award damages and relief (including any attorneys’ fees) authorized by law and/or the AAA’s Rules. The arbitration decision and award are final and binding with some exceptions under the FAA and judgement on the award may be entered in any court of competent jurisdiction. You agree that by entering in this agreement you and KJC Coatings are each waiving the right to a trial by jury and the right to participate in any CLASS, REPRESENTATIVE, OR COLLECTIVE proceeding. 


    • This agreement does not allow for a class arbitration even if the procedure or rules of the AAA would. Rather, you and we are only entitled to pursue arbitration on an individual, bilateral basis. Further and unless you and KCJ Coatings agree otherwise in writing, the arbitrator(s) may not consolidate more than one individual part’s claim with any other part’s claims and may not otherwise preside over any form of representative or collective proceeding. 


You and KJC Coatings are each responsible for our respective costs relating to counsel, experts, and witnesses as well as any other cost relating to the arbitration. KJC Coatings will however pay for the arbitration administrative or filing fees, including the arbitrator and/or other AAA case management fees for any seeking $75,000 or less unless the claim is determined by the arbitrator to be frivolous. Otherwise, the AAA’s Rules regarding costs and payment apply. This agreement to arbitrate does not preclude you from bringing issues to the attention of federal, state or local agencies. Such agencies can, if the law allows to seek relief against us on your behalf. 

If any term of this Section (Arbitration and Class Action Waiver) is to any extent illegal, otherwise invalid or incapable of being enforced such terms shall be excluded to the extent of such invalidity or unenforceability, all other terms hereof shall remain in full force and effect and to the extent permitted and possible the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term. If application of this Severability provision should materially and adversely impact shall be entitled to compensation for such adverse impact provided the reason for the invalidity or unenforceability of a term is not due to serious misconduct by the party seeking such compensation. 


User Comments, Feedback and other Submissions 

If at our request, you send certain specific submissions (ex-contest entries) or without a request from us you send creative ideas, suggestions, plans, proposals or other materials whether by online, postal mail, e-mail, or otherwise, you agree that we may at any without restriction, copy, edit, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We shall and are under no obligation (A) to maintain any comments in confidence, (B) to pay compensation for any comment(s), and/or (C) to respond to any comment. We may, but have no obligation to monitor, edit and/or remove content that we determine in our sole discretion are unlawful, threatening, offensive, defamatory, libelous, pornographic, obscene and/or otherwise objectionable or violated any party’s intellectual property of these Terms and Conditions. 

Your agreement that your comments will not violate rights of any third-party, including copyright, trademark, privacy, personality or other personal and/or proprietary right. Furthermore, you agree that your comment(s) will not contain any libelous or otherwise unlawful abusive or obscene material or contain any computer virus or other malware that could in any way affect the operation of the service(s) or any related website. You may not use a false e-mail address to pretend to be someone other than yourself or mislead us and/or any third-party as to the origin of any comments. You are sole responsible for any comments you make and their accuracy. We take responsibility and assume no liability for any comment(s) posted by our or any third-party. 


Prohibited Use(s) 

In addition to other prohibitions as set forth in the Terms and Conditions you are prohibited from using the site or its content: (1) for an unlawful purpose. (2) to solicit others to perform or participate in any unlawful acts. (3) to violate any international, federal provincial or state regulations, rules, laws or local ordinances. (4) to infringe upon or violate our intellectual property rights and/or others. (5) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability. (6) to submit false or misleading information. (7) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the “service” or of any related website, other websites or the internet. (8) to collect or track the personal information of others. (9) to phish, pharm, pretext, spam, spider, crawl, or scrape. (10) for any obscene or immoral purpose. (11) to interfere with or circumvent the security features of the service and/or any related website, other websites, or the internet. We reserve the right to terminate your use of the service or any related website for violating any of the prohibited uses. 


Indemnification 

You agree to indemnify, defend and hold harmless KJC Coatings and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees harmless from any claim or demand including reasonable attorneys’ fees made by any third-party due to and/or arising out of our breach of these Terms and Conditions or the documents they incorporate by reference or your violation of any law or the rights of a third-party. 


Severability 

In the event that any provision of these Terms and Conditions is determined to unlawful unenforceable or void such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions. 


Termination 

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our services or when you cease using our site. If in our sole judgement you fail or we suspect that you have failed to comply with any term or provision of these Terms and Conditions, we may also terminate this agreement at any time without notice and you will remain liable for all amounts due up to and/or including the date of termination and/or accordingly may deny you access to our services or any part thereof. 


Entire Agreement 

The failure of use to exercise and/or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to the service constitutes the entire agreement and understanding between you and us and govern your use of the service superseding any prior or contemporaneous agreement(s); communication(s) and proposal(s) whether oral or written between you and KJC Coatings, LLC. (Including but not limited to any prior versions of the Terms and Conditions). Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.
